Duration of Leave

Under most circumstances, you can receive up to 12 weeks of leave within any 12-month period. Leave due to care for an injured service member is capped at 26 weeks. However, leave to care for an injured service member is only available during one 12-month period. Moreover, during the 12-month period in which you take time off to care for an injured service member the combined total FMLA leave available is 26 weeks but the portion unrelated to care of

the injured service member cannot exceed 12 weeks. By way of example, if you take off 12 weeks for your own serious medical condition (the maximum you could take) you would be limited to 14 weeks to care for the injured service member. There are also special conditions and limitations on leave when both spouses work for ACST.
