Is Leave With or Without Pay

Leave normally is without pay. However, you must use any accrued paid vacation or PTO in lieu of taking unpaid leave under the FMLA. Such paid time will be counted towards your 12 weeks of FMLA leave.

Time off for a job-related injury that also qualifies as a serious health condition normally will be designated as FMLA leave. In this instance, the South Carolina Workers’ Compensation Act determines whether you are entitled to payment and, if so, the amount due. Likewise, if you are receiving short-term or long-term disability benefits you are not required to use paid leave.
